There are three main issues that are addressed in this Report. First, what we refer to
as “expression offences” – that is, those offences which are committed by expressing
a view which is racist in nature. Secondly, what are referred to as racially aggravated
offences, where a crime is committed with a racist motivation, or where the crime
is racially aggravated. Thirdly, and finally, those crimes which are committed on the
internet – or cybercrimes. In addressing each of these categories, we assess
international best practice, we look to academic commentary on the issue, we examine
two neighbouring jurisdictions in great detail, and, of course, look at the current Irish
position in relation to these three types of offences.
